  1. Who We Are
    1. The British Legion Benefits Service is operated by Blue Rock Loyalty Limited (“Blue Rock”) whose Registered Office is at 3 Southernhay West, Exeter, EX1 1JG (Registered in England No 06251481).
    2. Except as expressly stated, herein all references pertaining to and concerning British Legion Benefits may be taken to refer to Blue Rock and, reciprocally, all references to Blue Rock may be taken to refer to British Legion Benefits.
    3. Blue Rock has made British Legion Benefits available for the purpose of accessing and purchasing a wide range of goods and services (the “Goods”) via distance selling mediums. Any party, who avails themselves of any facilities afforded by British Legion Benefits, whether for the actual ordering or other purposes, in whatever format, is deemed to be a user (“User”) and is bound by these terms and conditions.
    4. In some circumstances, British Legion Benefits may be afforded in conjunction with a third-party organisation (an “Affinity Partner”) that has contracted Blue Rock to provide British Legion Benefits to their associates who may be, without limitation, their consumers, subscribers or audience. The Affinity Partner may act as an agent (“Agent”) in promoting British Legion Benefits by their own methods and activities. Notwithstanding this, any contract of sale or other agreement arising from the use of British Legion Benefits rests exclusively between the User and Blue Rock.
  2. Access to British Legion Benefits
    1. British Legion Benefits is only available to residents of the UK and Northern Ireland.
    2. Utilisation of all or part of British Legion Benefits may be subject to restrictions requiring the provision of personal identification information from and/or the issue of unique IDs and Passwords to Users. If we have cause to take this action, it may be necessary for Users to quote such details to gain access to, and when placing orders with, British Legion Benefits. Users will be entirely responsible for maintaining the confidentiality of their User ID and password. Users will be entirely responsible for all activities that occur under their User ID and password. Users will have the responsibility to notify us immediately of any unauthorised use of their User ID or any breach of security known to them.
    3. We reserve the right to terminate a Users ability to utilise British Legion Benefits if their conduct is found to be inconsistent with these terms and conditions, by giving the User fourteen (14) days written notice.
    4. If we have cause believe that a User is utilising British Legion Benefits with malicious or fraudulent intent to Blue Rock, an Affinity Partner or any connected third-party organisation, or if a User undertakes to use British Legion Benefits and its associated support services in a manner that may be deemed as ongoing nuisance, we reserve the right to withdraw all rights and privileges given to the User and to take all reasonable steps to deny the User access to British Legion Benefits. This action may be taken immediately without recourse to the User, and may involve litigation.
    5. Where access to British Legion Benefits has been afforded to a User by virtue of their relationship with an Affinity Partner, we reserve the right to withdraw all rights and privileges given to the User and to take all reasonable steps to deny the User access to British Legion Benefits upon notification from the Affinity Partner of the termination of the relationship. This action may be taken immediately without recourse to the User.
  3. Limitations
    1. These terms and conditions apply solely to the Goods afforded, represented and offered for sale directly by Blue Rock and British Legion Benefits to the User.
    2. These terms and conditions do not and cannot be taken to apply to those goods or services that carry express reference to alternative Terms and Conditions or where the goods and services promoted are obviously external to British Legion Benefits.
    3. Blue Rock affords to its Users or makes references to the services of external organisations for the purpose of delivering British Legion Benefits. However, Blue Rock does not warrant nor will it accept any responsibility for the content or services provided by Affinity Partners, other third parties or their agents.
    4. The existence of such references, links and associations do not constitute or represent any endorsement or other acceptance of responsibility of liability by Blue Rock for any goods or services afforded by such third parties, be they Affinity Partners or others.
    5. We encourage Users to read the Terms and Conditions, privacy statements and all other documentation relating to the goods and services afforded by any organisation that collects personally identifiable information or looks to undertake sales transactions with a User.
  4. Description and Availability
    1. Whilst every care has been made by Blue Rock to ensure the accuracy of information, all drawings, images, illustrations, descriptive material, specifications and advertising within British Legion Benefits are for the sole purpose of giving an approximate description of the Goods offered to assist your purchasing decision.
    2. We do not represent or warrant the accuracy or reliability of any of the information or content about any goods or services be it factual or illustrative, software or advertisements (together, the “materials”) advertised, promoted or offered for sale, contained within, distributed through, downloaded or accessed from such media as is associated with British Legion Benefits (the “Service”).
    3. Though items may be represented as emanating from or for use in countries other than the UK all Goods offered for sale through British Legion Benefits are available for delivery to the Mainland UK, Northern Ireland and BFPO addresses only (subject to clauses 6 and 7 below).
    4. All Goods offered through the Service are strictly subject to availability on an “as is” and “as available” basis.
  5. Copyright and Trademarks
    1. All design, text, illustrations and images together with the selection, arrangement and layout thereof are owned and are the copyright of BLUE ROCK or of our Affinity Partners, Suppliers or connected parties, which are used under license.
    2. Any unauthorised use of materials appearing in the British Legion Benefits Service may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.
    3. Permission is granted to copy and print portions of the materials for the sole purpose of placing an order with British Legion Benefits. Any other use of materials forming part of the Service (including reproduction for purposes other than that noted above and modification, distribution, or replication) without prior written permission of Blue Rock or the respective owner of the Copyright is strictly prohibited.
    4. All other trademarks or service marks are the property of their respective owners.
  6. Liability
    1. We make no promise that our Service will meet your requirements, or that it will be uninterrupted, timely or entirely error free.
    2. Blue Rock and its partners hereby excludes liability for any claims, losses, demands or damages of any kind whatsoever with respect to the Service or the materials including, without limitation, direct indirect, incidental or consequential losses or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Blue Rock. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.
    3. In any event nothing in this condition is intended to limit or curtail any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
    4. Blue Rock Ltd is not liable, either in contract, tort (including negligence) or otherwise for direct or indirect loss of profits, business or anticipated savings, nor for any indirect or consequential loss or damage or for any destruction of data.
    5. Blue Rock Ltd excludes all liability of any kind in respect of any material on the Internet which can be accessed via the Website and is not responsible in any way for any goods (including software) or services provided by third parties advertised, sold or otherwise made available by means of the Service or on the Internet;
    6. The accuracy, completeness or suitability for any purpose of any Content.
    7. Blue Rock Ltd is not liable either in contract, tort (including negligence) or otherwise for the acts or omissions of other providers of goods or services or for faults in those goods or services.
  7. General
    1. All Users acknowledge and agree to be bound by the terms of our privacy policy.
    2. Blue Rock reserves the right at its sole discretion, but without any obligation, to make amendments or improvements to, or withdraw or correct any error or omission in any portion of the Service or materials without notice.
    3. Failure by us to enforce any of these terms and conditions will not affect our right to enforce any of the remaining terms and conditions.
    4. If any provision of these Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
    5. These Conditions shall be governed by and construed in accordance with the laws of England and Wales. Should any dispute arise it will be resolved under the exclusive jurisdiction of the courts of England and Wales.
  8. Security
    1. Blue Rock directs you to advertisers offering discounted goods and services. It's these suppliers that are responsible to you for their secure transactions. Users can be reassured that while we do not offer purchasing from this site, we have a strict supplier selection process to ensure that we have a fair and good selection available to purchase.
